NOTICE OF A NON-EVIDENTIARY HEARING ON MOTION FOR SALE OF REAL PROPERTY FREE AND DIVESTED OF LIENS:
NOTICE IS HEREBY GIVEN THAT the Debtor has filed a Complaint for Sale of Real Property Free and Divested of Liens (Doc #1) seeking approval to sell the property located at: 5718 Wattsburg Road, Erie, Pennsylvania 16509 (more fully described in a Deed dated September 7, 2017 and recorded September 8, 2017 in the Office of the Recorder of Deeds of Erie County, Pennsylvania at Erie County Instrument No. 2017-019578) for the sum of $400,000.00 according to the terms set forth in the Complaint. An in-person hearing will be held on Tuesday, January 2, 2024 at 3:30 p.m. before Judge John C. Melaragno at the US. Courthouse, Room B160, 17 South Park Row, Erie, Pennsylvania 16501. The Court will entertain higher and/or better offers at the hearing. A successful bidder must deposit hand money of $5,000.00 at the time of the approval of the sale by the Court, with the balance due to be paid at closing of the sale.
You are further instructed to file with the Clerk, c/o US. Courthouse, Room B160, 17 South Park Row, Erie, Pennsylvania 16501 any Objections to the sale and serve upon the undersigned attorney for Movant a response to the Complaint by no later than December 21, 2023, in accordance with the Federal Rules of Bankruptcy Procedure, the Local Rules of this Court, and the general procedures of the presiding judge as found on the Court's webpage at www.pawb.uscourts.gov. If you fail to timely file and serve a written response, an order granting the relief requested in the Complaint may be entered and the hearing may not be held. Please refer to the calendar posted on the Court's webpage to verify if a default order was signed or if the hearing will go forward as scheduled.
