Notice is hereby given that the application of Purple Rock, LLC, a Pennsylvania limited liability company, for a use variance relating to property commonly known as and located at 2104 Hampton Road, City of Erie, County of Erie, Pennsylvania 16502 and bearing Erie County Tax Index No. (19) 6212-405 is deemed approved by operation of law pursuant to §908(9) and §908(10) of the Pennsylvania Municipalities Planning Code 53 P.S. §10908(9) and §10908(10) and §507.11 and §507.12 of the City of Erie Zoning Ordinance, based upon the failure of the City of Erie Zoning Hearing Board to render a written decision accompanied by findings of fact and conclusions based thereon together with the reasons therefor and the Board's failure to deliver said written decision to the applicant personally or by mail not later that one (1) day following the date of the written decision.

Pursuant to §908(9) of the Pennsylvania Municipalities Planning Code and §507.11 of the City of Erie Zoning Ordinance, the of Erie Zoning Hearing Board was required to render a written decision accompanied by findings of fact and conclusions based thereon together with the reasons therefor within forty-five (45) days of the final public hearing, which was held on May 21, 2026. The City of Erie Zoning Board failed to render a written decision accompanied by findings of fact and conclusions based thereon together with the reasons therefor within the mandated forty-five (45) days of the final public hearing. Further, §908(10) of the Pennsylvania Municipalities Planning Code and §507.12 of the City of Erie Zoning Ordinance require that the City of Erie Zoning Hearing Board deliver said written decision to the applicant personally or by mail not later than one (1) day following the date of the written decision. The City of Erie Zoning Hearing Board failed to deliver said written decision to the applicant or its attorney personally or by mail with one (1) day following the date of the written decision, if any. No waiver or extension of time was granted by the applicant of its attorney. The application and related materials may be examined at Erie City Hall, 626 State Street, Room 407, Erie, Pennsylvania 16501 during regular business hours.
